PEGASUS WELLBEING CLUB (PWC)
Terms & Conditions for School Registration
(Applicable to all PWC programmes unless specified otherwise)
1. Programme Scope & Nature- 1.1 Pegasus Wellbeing Club (PWC) is an enrichment programme and not a formal academic curriculum, medical service, therapeutic intervention, or counselling programme.
- 1.2 The programme is designed to support holistic child engagement through structured, age-appropriate activities and does not replace the school’s core academic or wellbeing responsibilities.
- 1.3 Participation of students is voluntary and subject to parental consent and school policies.

2.1 School Responsibilities: The school agrees to:
- Ensure a safe, supervised environment for all programme sessions
- Maintain appropriate student-to-adult ratios at all times
- Assign responsible staff for classroom supervision and discipline
- Ensure children participating are medically fit for general classroom activities
- Communicate programme details accurately to parents

2.2 Pegasus Responsibilities: Pegasus shall:
- Provide programme framework, material, and delivery as agreed
- Ensure programme facilitators (where applicable) are trained on PWC methodology
- Maintain professional standards during programme execution
- 3.1 The school retains primary responsibility for child safety, supervision, discipline, and wellbeing during all programme sessions.

3.2 Pegasus and/or its appointed facilitators shall not be held responsible for:
- Injuries arising from pre-existing medical conditions
- Incidents resulting from lack of supervision by school staff
- Behavioural issues between students
- Accidents occurring outside programme engagement time

3.3 The school confirms that:
- All statutory child protection norms are in place
- Emergency protocols and first-aid facilities are available on-site
- Parents are informed that the programme is facilitated within the school’s premises and supervision framework

4.1 The school agrees to indemnify and hold harmless Pegasus, its directors, employees, facilitators, and representatives against any claims, complaints, damages, or legal proceedings arising from:
- Alleged negligence, mishandling, or misconduct within the school premises
- Parental disputes, complaints, or litigation related to programme participation
- Injuries, accidents, or incidents involving students during programme sessions
- 4.2 Pegasus shall not be liable for indirect, incidental, or consequential damages under any circumstances.
- 5.1 The school is responsible for obtaining written or digital parental consent for student participation.
- 5.2 Any grievances raised by parents shall be first addressed by the school, and escalated to Pegasus only where directly related to programme material or facilitation.
- 5.3 Pegasus shall not engage in direct dispute resolution with parents unless formally requested by the school.
- 6.1 “Pegasus”, “Pegasus Wellbeing Club”, “PWC”, programme names, logos, materials, and content are intellectual property of Pegasus.
- 6.2 The school may use Pegasus branding only for approved programme communication, strictly during the programme period.

6.3 The school shall not:
- Modify programme materials
- Use Pegasus branding for unrelated activities
- Create derivative content or adaptations
- Represent the programme inaccurately
- 6.4 Any misuse of brand assets may result in immediate termination of programme association.
- 7.1 The school agrees to follow the recommended programme structure, session duration, and grouping guidelines.

7.2 Pegasus reserves the right to:
- Audit programme execution
- Withdraw programme association in case of misuse or misrepresentation
- Discontinue association if programme standards are compromised
- 8.1 Local programme exclusivity applies only as specified in the Signature Programme proposal.

8.2 Exclusivity is valid:
- Only during an active programme cycle
- Subject to minimum enrolment and execution timelines
- 8.3 Exclusivity does not restrict Pegasus from: Retail sales, Online sales, One-off events or non-Signature engagements.
- 9.1 Programme materials, training content, and guides shared with the school are confidential.

9.2 The school shall not:
- Share materials with third parties
- Replicate or reuse programme structure independently
- Record or distribute content without written consent
- 10.1 Either party may terminate participation with prior written notice in case of: Material breach of terms, Safety or compliance concerns, or Reputational risk.
- 10.2 Upon termination: All Pegasus branding must be removed, and Programme materials must be returned or destroyed.
- 11.1 This agreement shall be governed by and construed in accordance with the laws of India.
- 11.2 Any disputes shall be subject to the exclusive jurisdiction of courts located in New Delhi.
